Job Summary:
We are seeking a highly skilled and motivated Medical Malpractice Attorney to join our legal team. The ideal candidate will have extensive experience in handling medical malpractice cases, providing expert legal counsel, and advocating for clients who have suffered due to medical negligence. The successful applicant will demonstrate a strong commitment to protecting patients' rights and will have a proven track record of managing complex litigation cases from inception through trial.
Key Responsibilities:
Case Assessment: Evaluate potential medical malpractice claims by reviewing medical records, interviewing clients to learn about the malpractice they experience , and consulting with medical experts to establish the merit of each case. Investigating the operations of medical professionals to determine whether malpractice has occurred.
Legal Research and Writing: Conduct in-depth legal research and draft persuasive pleadings, motions, briefs, and other legal documents tailored to medical malpractice cases. Conducting research on the conditions their clients experience so they can speak about them in court using accurate details
Client Representation: Represent clients in negotiations, mediations, and court proceedings, maintaining a high standard of professionalism and ethical conduct.
Expert Collaboration: Work closely with medical professionals and expert witnesses to build strong cases, develop arguments for cases of malpractice, and present compelling evidence during litigation.
Trial Preparation: Drafting motions to use in courtroom proceedings, creating strategies for trials and hearing, prepare cases for trial, including developing case strategies, preparing witnesses, and organizing evidence to effectively present arguments in court.
Client Communication: Maintain regular communication with clients, providing updates on case progress and advising on legal options and strategies.
Settlement Negotiations: Negotiate settlements with opposing counsel on behalf of clients, aiming for favorable outcomes.
Facilitating Independent Evaluations: Requesting independent medical examinations to learn more about their clients' medical conditions.
Continuous Learning: Stay updated on changes in medical malpractice laws and regulations, as well as advancements in medical science that may impact cases.
Qualifications:
Juris Doctor (JD) degree from an accredited law school.
Minimum of 3 years of experience in medical malpractice law or related areas of practice.
Strong understanding of medical terminology, procedures, and healthcare regulations.
Exceptional analytical and problem-solving skills, with attention to detail.
Excellent oral and written communication skills.
Proven trial experience, with a successful track record in medical malpractice cases preferred.
Ability to handle a high volume of cases while managing competing priorities.
Preferred Skills:
Professional certifications in medical malpractice law (e.g., Board Certification).
Experience with alternative dispute resolution methods, such as mediation and arbitration.
Strong negotiation skills and a results-oriented mindset.
